Well, IANAL either but I used to have a good working knowledge of crim law
:)

It is my (lay) understanding that our current "people must be protected
from themselves" tort laws date from a decision made by a very senior
British judge (member of the privy council?).  Two law student friends of
mine could name the British judge and did not speak well of him :)

I believe that the Aus government is seriousy considering limiting the
right to sue.  Ie, making it a requirment to show clear negligence, etc.
This would be aimed at reducing the rediculously high personal
insurance premiums we have at the moment.

There was a case some years ago where a man jumped in to a shallow canal
on the Gold Cost right next to a "do not jump into water" sign, broke his
neck, sued, _and won_. This was overturned on appeal however, so it seems
to me the law is now requiring people to take some responsibility for
their actions.
